Notice of a Complete Application & Public Meeting

Concerning an Official Plan Amendment and a Zoning By-Law Amendment

D09-ELE-01-21 and D14-ELE-06-21


TAKE NOTICE that the Council of the Corporation of the Township of Cramahe has received a complete application for an amendment to the Township of Cramahe Official Plan and the Township of Cramahe Comprehensive Zoning By-law No. 08-18, as amended, and is notifying the public in accordance with Sections 22 and 34 of the Planning Act.


AND TAKE NOTICE that the Council of the Corporation of the Township of Cramahe will hold a Public Meeting to consider the proposed Official Plan Amendment and Zoning By-law Amendment.


Date and Time of Meeting:          Tuesday, June 22, 2021, at 6:00 p.m.

Location of the Subject Lands

The lands subject to the proposed amendments are located at 1 Church Street East, Colborne, in the Township of Cramahe. A key map is attached showing the location of the subject lands.


Purpose and Effect of the Official Plan and Zoning By-law Amendments

These Amendments are required to permit the repurposing of the existing under-utilized church building and associated property to a 16-unit residential apartment (condominium). The subject lands are currently designated Community Facility and are zoned the Community Facility (CF) Zone. As proposed, the land use designation will be changed to Village Residential and the zone category will be changed to the Residential 3 - Exception 9 (R3 -9) Zone, to reflect the existing lot frontage, lot area, and exterior side yard setbacks. Reductions in the lot coverage, landscaped open space, interior side yard and rear yard setback will also be reflected in the exception regulations. The reductions are a result of the intensification and repurposing of the site.



Any person may attend the public meeting and make written and/or verbal representation either in support of or in opposition to the proposed Amendment. Signed, written submissions will be accepted by the Clerk prior to the meeting. Who Can Submit A Notice of Appeal:

Only individuals, corporations or public bodies defined in the Planning Act may appeal a decision of the approval authority to the Local Planning Appeal Tribunal.  A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.


No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to Council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.


Official Plan Amendment

The County of Northumberland is the approval authority for amendments to the Township of Cramahe Official Plan amendment. Provided that Council for the Township adopts the Official Plan amendment, the amendment is then forwarded to the County for Approval. There is no appeal of the local decision to adopt the Official Plan amendment. Appeal of the decision to approve the amendment by the County may be the subject of an Appeal to the Local Planning Appeal Tribunal, as set out in the Notice of Decision to amend the Official Plan, issued following the decision by the County of Northumberland.


Zoning By-law Amendment

The Township of Cramahe is the approval authority for an amendment to the Township of Cramahe Comprehensive Zoning By-law 08-18. A decision by the Township to amend By-law 08-18 may be appealed to the Local Planning Appeal Tribunal.


Notice of Passing of Zoning By-law Amendment: A copy of the will be sent to the applicant, and to each person who appeared at the scheduled meeting and who has filed with the Clerk a written request for Notice of the Decision.
